Terms and Conditions

MobileShots is a product of Brainglab, an IT services consultancy based in Santiago, Chile. These terms cover your use of the website and the app. By creating an account or using the editor, you accept them.
1. Who you are dealing with
The service is operated by Brainglab, based in Santiago, Chile. Throughout this document, "we" means Brainglab and "you" means the person using MobileShots.

2. Your account
The editor works without an account. You need one only to save shots, because saving means keeping them on our servers so you can open them again from another computer.
You are responsible for your password and for what happens under your account. Tell us at contacto@brainglab.com if you think someone else is using it.
You must be at least 13 years old to create an account. If you are under 18, you need permission from a parent or guardian.
One person, one account. Accounts are not transferable.
3. Your screenshots stay yours
The screenshots you upload and the images you export belong to you. We claim no ownership over them and we do not use them to promote the product, to train any model, or for anything other than showing them back to you.
You may use what you export however you like, including commercially: landing pages, app store listings, presentations, client work.
To run the service we need permission to store your files and show them to you — nothing wider than that. That permission ends when you delete the shot or close your account.
You are responsible for the content you upload: it must be yours to use, and it must not break the law or anyone else’s rights.
4. What you may not do
Do not use MobileShots to produce material that is illegal, that impersonates someone, or that infringes copyright, trademarks or privacy.
Do not try to break, overload or work around the service: no automated abuse, no attacks, no attempts to reach other people’s accounts or files.
Do not resell the service as if it were yours, and do not copy the device models, the interface or the code, which are ours.
5. Free plan and Pro plan
The free plan keeps a limited number of shots on the server and exports to JPG at 1x. Pro removes the limit and adds PNG and WebP at 2x and 3x, along with the features marked as Pro inside the app.
The current price is shown on the pricing section of the home page before you pay. If we ever change it, the new price applies to renewals after we tell you, never retroactively.
Pro is billed monthly and renews on its own until you cancel it.
6. Payments, invoices and taxes
Payments are processed by Polar Software Inc., which acts as merchant of record. That means Polar is the seller on the receipt, issues the invoice and handles the sales taxes that apply where you live.
We never see or store your card number. What we keep is the fact that your subscription is active and when it renews.
Any question about a charge, an invoice or a payment method can be sent to contacto@brainglab.com and we will help you sort it out with Polar.
7. Cancelling and refunds
You can cancel Pro whenever you want, from your account. No calls, no forms.
When you cancel, Pro stays active until the end of the period you already paid for. After that the editor keeps working with the free limits, and the shots above the free limit stay in your account without being deleted — you just cannot add new ones until you are under the limit again.
If something went wrong — a charge you did not expect, a service that did not work — write to us within 14 days at contacto@brainglab.com and we will look at your case. Refunds are issued through Polar. This does not affect the rights that Chilean consumer law, Ley 19.496, gives you.
8. Availability and changes
We work to keep MobileShots available, but we do not promise it will never be down. Maintenance, a failure at a provider or something outside our control can interrupt it.
We may change or remove features. If a change takes away something significant that you were paying for, we will tell you beforehand by email.
We may discontinue the service. If that happens, we will give you at least 30 days’ notice and a way to download your shots.
9. What we are responsible for
MobileShots is provided as it is. We do not guarantee that it will suit a particular purpose or that the result will be free of defects.
Keep your own copy of anything that matters. We take backups, but the service is not an archive and we cannot promise that a file will always be recoverable.
To the extent the law allows, our liability is limited to what you paid us in the twelve months before the problem. Nothing here limits liability for fraud, wilful misconduct or anything that cannot be limited under Chilean law.
10. Closing an account
You can close your account whenever you want by writing to contacto@brainglab.com. Your shots and their images are deleted with it.
We may suspend or close an account that breaks these terms, that is used to attack the service, or that we are required to close by law. Where it is reasonable to do so, we will warn you first.
11. Changes to these terms
We may update these terms. The date at the top of this page always says when they last changed.
If a change matters — prices, your rights, how your data is handled — we will tell you by email before it takes effect. Carrying on using the service after that means you accept the new version.
12. Applicable law and courts
These terms are governed by the laws of the Republic of Chile.
Any dispute will be heard by the ordinary courts of the city of Santiago, Chile, without this affecting the right of a consumer to go to the court of their own domicile or to the National Consumer Service, SERNAC, where the law allows it.
